Trademark search in Latvia

Often there are several disputes arising over the intellectual property rights due to the protection of trademarks, patents, designs and copyrights. The most frequent intellectual property dispute in Latvia is over trademarks due to the fact that there has already been registered and earlier similar or identical trademark, which is resulting in a likelihood of confusion for trademarks in Latvia. One of the options to avoid such disputes is to carry out the trademark search in Latvia in order to ascertain that no similar or identical trademarks have already been registered before.

 

Before the registration of a new trademark in Latvia, it is necessary to carry out the trademark search in Latvian, European and international databases in order to ensure that no rights of an earlier trademark are infringed. According to Laws on Trademarks an earlier mark has a priority, thus all later trademarks that are found similar or identical to the earlier one can be declared invalid from the date of registration in case the opposition is being filed by another party.

 

Trademark search in Latvia can be carried out by the Patent and Technology Library, which runs the trademark search by wording, graphical search, specific element search of trademarks, trademark number or owner, and other criteria. The Patent and Technology Library can provide the results from Latvian trademark database, European Union trademark database, international trademark database as well as several other foreign databases according to the information requested by the client.

Partial trademark search in Latvia can be carried out also manually by the individual by using publicly available databases, such as “trademarks” for trademarks in Latvia, “eSearch plus” for European Union trademarks (EUIPO database) and “Romarin” for international trademark search (WIPO database). For example, in the database “trademarks” for trademark search in Latvia you can sort and find trademarks by several criteria, such as: registration or application numbers, trademark owner, Nica classification, trademark type or colour, verbal part (trademark as a whole or only part of it) of a trademark and others.
